The Bonds will be issued as exempt facility bonds for a qualified residential rental project pursuant to section 142(a)(7) of the Internal Revenue Code of 1986, as amended (the "Code"). The Texas Department of Housing and Community Affairs (TDHCA) Compliance Division plans to present a training with regards to The Housing Opportunity Through Modernization Act of 2016 (HOTMA). The HOTMA rule was officially published in the Federal Register on February 14, 2023. TDHCA has until January 1, 2024, to implement the broader income and asset changes in Sections 102 and 104. The Department understands that recertifications with an effective date of January 1, 2024, or soon thereafter, will be started in September of this year, 120 days prior to the anniversary. The Department is offering a comprehensive training on HOTMA on September 8, 2023. The training will run from 9 am until approximately 3 pm. This will be a virtual offering. This training will be beneficial for all of the Department¿s housing partners operating in any of the multifamily (HOME, TCAP-RF, HOME-ARP, NHTF, NSP, HTC, BOND, Exchange, TCAP and THTF) programs and Section 811.
